SC Blamed for Religious Wars: Dubey’s Claim

BJP MP Nishikant Dubey accused the Supreme Court on Saturday of instigating religious wars in the country. He argued that the court was exceeding its limits and questioned the need for Parliament and state Assemblies if every issue had to be resolved by the Supreme Court.

SC Decisions on Homosexuality and IT Act Challenged

Dubey pointed to the court’s decisions to decriminalize homosexuality in 2018 and strike down section 66(a) of the Information Technology Act in 2021 as instances of overreach. He claimed that all religious communities considered homosexuality wrong and that section 66(a) was necessary to prevent the misuse of online platforms for sharing objectionable content.

SC’s Approach to Temple and Mosque Issues Criticized

Dubey criticized the court’s approach to temple and mosque issues, saying that the court demanded documents for Ram temple and Krishna Janmabhoomi but did not require them for mosques built after the arrival of the Mughals.

Dubey Questions SC Directives to President

Dubey also questioned how the Supreme Court could issue directives to its appointing authority, the president. He was referring to the court’s April 8 judgement imposing a three-month deadline for the president to approve or reject bills referred by state governors.

SC’s Lawmaking Role Questioned

Dubey argued that Parliament made the laws of the country and questioned the court’s authority to dictate to Parliament. He also questioned the basis for the court’s three-month deadline for the president’s decision on bills.

Dubey’s Comments on Waqf Amendment Act

Dubey’s comments came amid the Supreme Court hearing challenges to the recently-passed Waqf Amendment Act. The Union government had told the court that some provisions of the Act, such as the denotification of existing waqf properties, would not be enacted until the court heard the matter again.

SC’s Proposal to Stay Some Provisions of Waqf Amendment Act

The court had proposed to stay some of the amended Act’s provisions, including the inclusion of non-Muslims in waqf boards and the denotification of properties declared as waqf by courts.
