Delhi Court Issues Notice to FSL Director in Defacement Case Against Arvind Kejriwal
Court Orders Personal Appearance Over Non-Filing of Report
A Delhi court has issued a notice to the director of the Forensic Science Laboratory (FSL). The director must appear in person. This is due to the non-filing of a report related to a CD in a defacement case. The case involves former Chief Minister Arvind Kejriwal.
Background of the Case
On May 23, the court directed the FSL director to examine a CD. This CD is part of a case involving the defacement of public property. The court asked for a report to be filed.
An FIR has already been registered in this case. It is against former CM Arvind Kejriwal, ex-MLA Gulab Singh, and MCD councillor Nitika Sharma. The charges are under Section 3 of the Delhi Prevention of Defacement of Property Act, 2007. This section deals with penalties for defacing public property. The maximum punishment is one year in prison and a fine of up to Rs 50,000.
Court’s Notice and Observations
Additional Chief Judicial Magistrate (ACJM) Neha Mittal issued the notice. The FSL director must appear in person on June 28. The court noted that the notice issued to the FSL director had been received. However, no report has been received from the director.
Allegations and FIR Registration
The case stems from an application filed by Kumar Saxena. Saxena alleged that Kejriwal, along with other political figures, misused public funds. They displayed hoardings at various locations in Dwarka in 2019.
On March 11, ACJM Mittal observed that a cognisable offence was committed. The court directed the SHO concerned to register an FIR immediately. The charges are under Section 3 of the Delhi Prevention of Defacement of Property Act, 2007, and for any other offence that appeared to have been committed.
